TERMS AND CONDITIONS
1. Definitions
1.1 “Australian Consumer Law” refers to Schedule 2 of the Competition and Consumer
Act 2010 (Cth).
1.2 “Fees” means the fees set out on the Website as amended from time to time plus any
applicable Travel Fees.
1.3 “Services” means the pre and post natal midwifery care, childbirth education,
breastfeeding, chest feeding and lactation support and management via in person
consultations, telehealth, courses, education programs and written and video media
and any ancillary advice provided by Bond Lactation Consulting.
1.4 “Travel Fees” are calculated as $1.00 for each kilometre travelled past a 15km radius
of 4171.
1.5 “Website” means www.bondlactation.com.au.
1.6 “You” or “Your” refers to a person that accepts these Terms and Conditions to
engage the Services of Bond Lactation Consulting.
2. Application of Terms
2.1 By using any Services provided by Bond Lactation Consulting You agree to the
following terms and conditions.
2.2 If You do not agree with these Terms and Conditions, You must not use the services
provided by Bond Lactation.
3. Acceptance of Terms
3.1 By entering into an agreement for Services with Bond Lactation Consulting, You
accept these Terms and Conditions, the booking schedule and the Fees displayed on
the Website.
4. Cancellation Policy
4.1 Notice of cancellation or rescheduling of an appointment must occur by telephoning
or emailing Bond Lactation Consulting at the phone number and email address
provided on the Website from time to time.
4.2 A minimum of 24 hours’ notice is required for rescheduling appointments.
4.3 Rescheduling an appointment within 24 hours of the appointment will incur a fee of
50% of the consultation fee unless the appointment is rescheduled within one week of
the original appointment or at Bond Lactation Consulting’s earliest convenience.
4.4 A minimum of 48 hours’ notice is required for cancelling appointments.
4.5 Cancellation within 48 hours of an appointment will incur a cancellation fee of 50% of
the consultation fee.
4.6 A failure to be present for an appointment will incur a fee of 100% of the consultation
fee plus any Travel Charges.
4.7 If Your appointment is cancelled by Bond Lactation Consulting, You will not incur any
financial penalty.
5. Limitation of Liability and Disclaimer
5.1 You acknowledge in receiving the Services that Bond Lactation Consulting’s
personnel are not registered medical practitioners and are not providing You with
medical services.
5.2 Bond Lactation Consulting does not provide medical advice. If medical advice is
required it should be sought from a qualified medical practitioner. To the fullest extent
permissible by law, Bond Lactation Consulting disclaims all liability, express or
implied, in respect of the Services or information provided to You.
5.3 To the extent permitted by law and subject to the Australian Consumer Law, Bond
Lactation Consulting, Isabella Wood, RN and IBCLC will not be liable for any injury,
loss, claim, or any direct, indirect, incidental, special or consequential damages of
any kind, whether based in contract, tort (including negligence), or otherwise, arising
from the Services, or for any other claim related in any way to the Services or any
product, including, but not limited to, any errors or omissions, or any loss or damage
of any kind incurred as a result of the use of the Services or advice or information
provided.
5.4 Bond Lactation Consulting’s aggregate liability, whether in contract, tort (including
negligence or breach of statutory duty howsoever arising), misrepresentation or
otherwise, arising in connection with the performance of the Services will not exceed
the total fees paid by You to Bond Lactation Consulting.
5.5 The above limitations do not apply to breaches due to the gross negligence or wilful
misconduct of the Bond Lactation Consulting.
6. Indemnities
6.1 To the extent permitted by law and subject to the Australian Consumer Law, You
hereby indemnify and agree to keep indemnified Bond Lactation Consulting against
all liabilities, costs, expenses, damages, fines, penalties and/or losses (including any
direct, indirect or consequential losses, loss of profit, loss of reputation and all
interest, penalties and legal costs and all other professional costs and expenses)
suffered or incurred by or awarded against Bond Lactation Consulting and/or its
affiliates and/or for which Bond Lactation Consulting and/or its affiliates may become
liable, arising out of or in connection with the provision of Services by Bond Lactation
Consulting.
6.2 All indemnities survive termination of the Services.
7. General
7.1 If any provision of these Terms and Conditions becomes void or unenforceable, it will
be severed from this agreement without affecting the enforceability of the other
provisions which will continue to have full force and effect.
7.2 These Terms and Conditions are governed by the laws of Queensland, Australia and
each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of
the courts of Queensland, Australia.
7.3 Bond Lactation Consulting reserves the right at all times to make changes to these
Terms and Conditions. Any variations to these Terms and Conditions will take effect
when posted on the Website. The Terms and Conditions which are in effect at the
time in which You and Bond Lactation Consulting enter into an agreement for
services are those that will govern the provision of those services.
7.4 A failure or delay by Bond Lactation Consulting to exercise a power or right under
these Terms and Conditions does not constitute a waiver of that power or right, and
the exercise of a power or right by Bond Lactation Consulting does not preclude its
future exercise or the exercise of any power or right.
8. Complaints
8.1 Bond Lactation Consulting is committed to its clients and providing a positive
customer experience. If You are not satisfied with the services provided by Bond
Lactation Consulting, please contact bondlactation@gmail.com. For further

PRIVACY POLICY
1. General
1.1 Your privacy is extremely important. Bond Lactation Consulting is committed to
respecting Your privacy and upholding the security of Your personal information, so
You can feel confident when interacting with our services.
1.2 Bond Lactation Consulting is committed to providing You with the best possible
customer service experience while protecting Your personal and health data. Bond
Lactation Consulting is bound by the Privacy Act 1988, which sets out a number of
principles concerning the privacy of individuals. This Privacy Policy relates to both the
use of this website and the clinical and practice management aspects of Bond
Lactation Consulting.
1.3 All defined terms in this Privacy Policy have the meaning given to them in clause 1 of
Bond Lactation Consulting’s Terms and Conditions.
2. Collection of Personal Information
2.1 We collect personal information You provide to us directly, for example, in person
during a lactation consultation, over the phone, by email, or through our website. All
personal information is stored on password-protected electronic devices.
3. Use of Personal Information
3.1 We use the personal and health information You provide to make clinical
assessments and develop a management and lactation plan for You and Your child.
Where necessary, such as in correspondence with Your GP or other health
professionals, Your health information may also be used for ongoing management
and care. Other than for the purpose for which You have provided us with Your
personal and health information, we may also use it for other related purposes or as
permitted or required by law. Related purposes include:
- Issuing receipts
- Responding to Your comments or questions
- Child protection issues
3.2 We will not share or sell Your personal information to any third party without Your
consent.
4. Cookies
4.1 When You visit our website, we will collect and store Your computer’s assigned IP
address, the date and time of Your visit, the information accessed, and the referring
page. We will also collect other non-identifying data for statistical purposes. This
information is not linked to Your personal information unless required by law. You
have the ability to accept or decline cookies by modifying the settings in Your
browser.
